1.               General

1.1            This privacy policy governs the way Helensvale Nominees Pty Ltd ACN 609 079 852, its related bodies corporate, and the centre management (Programmed Property Services ACN 106 015 632 or their nominated successor) (the Leisure Centre, we, our, us) handles personal information and sensitive information. It applies to all personal information and sensitive information we collect in connection with a member’s (you, your) use of the Leisure Centre and through our dealings with you.

1.2            We operate the Surrounds Leisure Centre at 6 Emerald Drive, Helensvale QLD 4212. The services we provide include: provision of gym equipment, bathroom and change rooms, furniture, lockers, and anything on the premises that you use or have access to including the pool, through your membership of the Leisure Centre (subject to your Leisure Centre membership contract).

1.3            The nature of our services means that we may collect, handle and disclose a broad range of information about you, including personal information. ‘Personal information’ is information or an opinion about you (whether true or not) that identifies you or from which your identity is reasonably identifiable. Personal Information may include ‘Sensitive Information’ which may include health and medical conditions and other information we collect about you.

1.4            Please take a moment to read this privacy policy as it explains how we collect and handle your Personal Information, and in what circumstances we will disclose your Personal Information to third parties. 

2.               Purpose

2.1            We comply with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), which regulate how we may collect, use, disclose and store Personal Information.

2.2            The purpose of this privacy policy is to keep you informed of the ways we gather, manage, store, disclose and protect your Personal Information, as well as to help you to understand your rights, and our obligations under the Privacy Act.

3.               Changes to this privacy policy

3.1            We may change this privacy policy from time to time. The updated privacy policy will be posted on our website at www.surroundsleisurecentre.com.au , with the date of the update shown.

4.               Information we collect about you

4.1            We collect information about you that we reasonably need for our business functions and activities, which predominantly involves providing the services described above through your membership of the Leisure Centre. 

4.2            We information we may collect about you includes:

(a)             your name, address and contact details (phone and email);

(b)             your date of birth;

(c)             information about your occupation;

(d)             emergency contact details;

(e)             credit card and other payment details; and

(f)               financial information, including information relating to your credit worthiness.

4.3            We may also collect and hold Sensitive Information about you, such as information about your health and medical conditions, where collecting this information is reasonably necessary for the provision of our services.

5.               How we collect information about you

5.1            We will collect and hold your Personal Information in a fair and lawful manner. Where it is reasonably practical to do so, we will collect your Personal Information directly from you. For example, we may collect the Personal Information and Sensitive Information you directly give us directly through some of the following means:

(a)             when you make a general enquiry through our website;

(b)             when you communicate with us via phone, email, SMS, social media or face to face;

(c)             when you provide us with membership documents; or

(d)             when administering any of our services.

5.2            Where it is not reasonably practical for us to collect your Personal Information from you directly, we may collect Personal Information about you from third parties or from publicly available sources. For example, your Personal Information may be provided to us by one of your contacts through a membership promotion. 

5.3            If we collect Personal Information about you from a third party we will, if appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to and correct and update the information.

5.4            We use third party gateways, such as Ezidebit Pty Ltd to process payments. Such payment processors collect and use your Personal Information subject to their own privacy policies available on their websites.

6.               Unsolicited information

6.1            If we receive Personal Information about you that we have not requested, and if we determine that we could not have lawfully collected that information under the Privacy Act if we had requested it, we will destroy or de-identify the information (if it is lawful and reasonable to do so). If we collect your Personal Information in an unsolicited manner, we will take reasonable steps to inform you of such collection and also how we use, disclose and secure your Personal Information where appropriate. Such reasonable steps may include referring you to this privacy policy.

7.               Do I have to provide you with my Personal Information?

7.1            It is generally not practical to remain anonymous or to use a pseudonym when dealing with the Leisure Centre as we usually need to use your Personal Information to provide services to you. If you choose not to provide us with your Personal Information, we may not be able to provide you with requested products or services, or provide you with requested information concerning an enquiry, account or complaint.

8.               Purpose for handling your Personal Information

8.1            As a general rule, we only process Personal Information for purposes that would be considered relevant and reasonable in the circumstances. We collect, hold, use and disclose Personal Information to:

(a)             to fulfil obligations under your membership contract or any other contract between you  and the Leisure Centre;

(b)             to render services under a member’s membership contract;

(c)             to provide information about products, service or special offers to members;

(d)             to obtain opinions or comments about products or services from members;

(e)             to record statistical data for marketing analysis from members;

(f)               to process and consider an application for employment;

(g)             to promote and market all current and future Leisure Centre businesses, venues, products and services and to inform new members about the products and services of the Leisure Centre commercial partners;

(h)             to assist with the Leisure Centre internal business processes;

(i)               to conduct market research or to improve the Leisure Centre’s products and service offerings;

(j)               to administer contests, promotions and surveys;

(k)             for any other purposes that could be reasonably expected of the Leisure Centre;

(l)               to enable the Leisure Centre to comply with its obligations under law; and

(m)            otherwise manage our business.

8.2            We may also use your Personal Information for activities in support of our primary business functions such as processing payments, administration, recruitment, management, IT, legal, and customer support.

9.               Protection of your Personal Information

9.1            We will hold Personal Information as either secure physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers.  It is not our usual practice to send data overseas.

9.2            We maintain appropriate physical, procedural and technical security for our office and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of Personal Information. This also applies to disposal of Personal Information. We will destroy or de-identify your Personal Information once it is no longer needed for a valid purpose or required to be kept by law.

10.            Disclosure of Personal Information

10.1         We may disclose your Personal Information to:

(a)             related entities of the Leisure Centre;

(b)             contractors, agents and suppliers the Leisure Centre engages to provide products and/or perform services;

(c)             commercial partners with whom the Leisure Centre has agreed information sharing arrangements with;

(d)             the Leisure Centre’s professional advisors such as legal professionals and accountants;

(e)             law enforcement bodies;

(f)               a purchaser of all or part of the Leisure Centre’s business; and

(g)             any other person for any other purposes that would be reasonably expected (including if required by law).

10.2         If we disclose information to a third party, where appropriate and practical, we will require that third party to protect your information to the same extent that we do.

10.3         Sensitive Information we collect includes information a member has disclosed to us about their physical and mental health and wellbeing.

10.4         Sensitive information will only ever be used for providing services to members. Such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of The Leisure Centre, any Leisure Centre group company, or any member of the public, or to lessen a serious threat to a person’s health or safety.

10.5         We or the Leisure Centre manager sometimes film or photograph the Leisure Centre so it is possible you will appear in the background. By signing your member contract, you allow us to use your image in promotional and other business-related material. 

11.            Direct marketing

11.1         We do not generally send marketing communications. On the rare occasion where we send you a marketing communication, such as an email alert about new products or services, we will ensure you have the opportunity to ‘opt out’ by using the unsubscribe button on that marketing communication. Alternatively, you may contact us at any time to unsubscribe by using the contact details provided at the bottom of this privacy policy.

12.            Cookies

12.1         A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time.  We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing our Websites.  This information will help to better adapt the Websites to suit personal requirements.  While cookies allow a computer to be identified, they do not permit any reference to a specific individual.  For information on cookie settings of your internet browser, please refer to your browser’s manual.

13.            Accessing and correcting your Personal Information

13.1         You may contact our Privacy Officer using the contact details below to request access to, or a correction of, the Personal Information that we hold about you. We will deal with your request within a reasonable time. On the rare occasion that we refuse access, we will provide you with a written notice setting out the reasons for the refusal and the relevant provisions of the Privacy Act that we rely on to refuse access.  We will also provide you with avenues to complain about our refusal to provide you with access to the information.

13.2         We are not obliged to correct any of your Personal Information if we do not agree that it requires correction. If we refuse a correction request, we will provide you with a written notice with our reasons for refusing.  We may recover reasonable costs in relation to a request for access to Personal Information.
